Welcome to Shot-up! These Terms of Service (“Terms”) govern your access to and use of the Shot-up app, operated by members of the aug team as a side project. By accessing or using Shot-up, you agree to these Terms. If you do not agree, please discontinue use of the app.

By using Shot-up, you agree to comply with these Terms, as well as our Privacy Policy, which is incorporated herein by reference.

2. About Shot-up

Shot-up is a tool designed to help users analyze, record, and interact with their uploaded photos and chat history using AI-powered capabilities. The app has been developed as a side project by members of the aug team.

3. Eligibility

You must be at least 13 years old to use Shot-up. By using the app, you confirm that you are of legal age to enter into this agreement or have the consent of a parent or guardian if you are a minor.

4. User Responsibilities

a. Account and Usage

You are responsible for ensuring that any information you upload to Shot-up, including photos and chat content, complies with applicable laws and does not infringe the rights of others.
You may not use Shot-up for unlawful, harmful, or malicious purposes.

b. Uploaded Content

You retain ownership of any photos, text, or other materials you upload or share within Shot-up.
By uploading content, you grant Shot-up and its third-party API providers (such as OpenAI) a limited, non-exclusive, and revocable license to process the content solely for providing the app’s services.

c. Prohibited Conduct

You agree not to:

Use the app in a way that violates any local, state, national, or international law.
Upload content that is offensive, obscene, defamatory, or otherwise inappropriate.
Attempt to reverse-engineer, tamper with, or hack the app or its services.

5. Data Processing and Third-Party APIs

To provide AI-powered capabilities, Shot-up shares your uploaded photos and chat history with third-party APIs, specifically the OpenAI API, for analysis.

By using the app, you consent to the processing and sharing of your data with third-party providers.

6. Intellectual Property

a. Shot-up Intellectual Property

All intellectual property related to Shot-up, including but not limited to its design, features, and software, is owned by the aug team.
You are granted a limited, non-exclusive, and revocable license to use Shot-up for personal, non-commercial purposes.

b. User Content

You retain ownership of your content but grant Shot-up a license to use it as necessary to provide the app’s functionality.

7. Disclaimers and Limitation of Liability

a. No Warranty

Shot-up is provided “as is” and “as available” without warranties of any kind, express or implied.
We do not guarantee that the app will be error-free, uninterrupted, or meet your expectations.

b. Limitation of Liability

To the fullest extent permitted by law, Shot-up and the aug team will not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the app.

8. Indemnification

You agree to indemnify and hold harmless Shot-up, the aug team, and their affiliates from any claims, damages, liabilities, losses, or expenses arising from your use of the app, your content, or any violation of these Terms.

9. Modifications to the App or Terms

We reserve the right to modify or discontinue Shot-up (or any part of it) at any time, without notice.

We may also update these Terms periodically. Continued use of the app after changes to the Terms constitutes acceptance of the revised terms.

10. Termination

We reserve the right to terminate or suspend your access to Shot-up at our discretion, without notice, if you violate these Terms or engage in prohibited activities.
